Người ta biết được vì sao người ta mưốn li dị nhanh nhanh nên mình cũng ko nên năn nỉ làm gì. Khi tình yêu và tình nghĩa ko còn, người ta muốn làm gì cũng được miễn người ta thấy vui vẻ và hạnh phúc suốt phần đời còn lại của ng ta.
Mong có chị nào biết trả lời giúp em. E đã dọn ra ngoài sống nên mọi thứ đều tốn kém. Em không muốn đi hỏi luật sư vì lại phải trả 1 khoản tiền. Em cảm ơn.

Đừng kí giấy vì khả năng xin thẻ xanh bằng bản thân bạn rất khó. Hãy thương thảo với chồng. Ảnh chỉ muốn e kí giấy xong, ảnh xong trách nhiệm. Ở Mĩ này khi ra tòa ai có lí thì thắng chứ chẳng có tình nghĩa gì đâu. 6 tháng hôn nhân của bạn rất ít bằng chứng để thuyết phục ng ta tin hôn nhân bạn là thật. Chúc bạn may mắn.
NO! I have to start this article by saying that I am not encouraging divorce in any way. My discussion below is strictly a timing discussion, meaning you have decided to get divorced but don’t know when. Many of my clients are under the misconception that it is better to apply for their 10 year card in a bad marriage rather than no marriage. Don’t do it!
The I-751 is the application that is filed to remove the condition, meaning applying for your permanent permanent residence card (10 year green card). The rule is that you can file this from three (3) months before the expiration of your card up until the day it expires. If you file after the day it expires you better have a compelling reason for doing so, like a medical emergency, car accident, or the like. “I forgot” won’t cut it and you will be denied for a late filing.
There is an exception to the above. If you get divorced you can file right away, meaning you don’t have to wait. Technically, you can get married on Tuesday, file for your green card on Wednesday, and get divorced on Thursday and USCIS is supposed to give you your green card. I say technically because you will be put through hell to test if your marriage was real and you will likely have several denials and have to obtain your green card through the courts. I give you this extreme example because it is important you understand the legal test. That is “when you got married you intended to establish a life together AT THE MOMENT YOU GOT MARRIED.” If the marriage breaks up later on that is ok and, in this warped system, you actually get the benefit of filing earlier than someone who has a good marriage that spans the two years.
There is another benefit to filing the I-751 divorced. You see, in order to satisfy the legal test above you need to provide documents and, if you are still married, both you and your spouse must attend the interview, if there is an interview. The shorter the marriage, the less documents you must produce. Therefore, if you go to an interview after only being married six months the officer can only look at six months worth of documents. Also, you don’t have to bring your spouse if you are divorced. Hence, the interview for a divorced couple is actually easier than one where the couple is still married. Again, I am not encouraging divorce, only the timing of it if it is going to happen anyway.
The last point I want to make on this topic is the “friendly” soon-to-be ex-spouse. Many of my clients ask “Mr. Toscano, my wife/husband and I are still friends and he/she is willing to help me so isn’t it better that we stay married till after the application?” NO, AGAIN! Marriages and divorces are incredibly emotional events. If you and your soon-to-be ex-spouse get into a fight the week before the interview and you have filed together, you have a serious problem. Now you need them at the interview. Don’t tell me it can’t happen. I have seen it. Don’t take the chance. Do the divorce before you file your I-751. If you are close to the date you must file by, USCIS gives you 4 months to get a copy of the divorce and that can be extended.
I can honestly say that I have never had a divorced I-751 fail to this point in my practice. In the interested of full disclosure, I have one client currently that has a 2nd interview pending on this application, which is highly unusual. However, the reason that client is having difficulty is that they had almost no documentation. You still need to produce documents and the more the better. The more of them you have, the better the case and some of my clients that produce a lot of documents don’t have an interview at all. Specific scenarios need to be discussed with an attorney to ensure your success in getting your ten-year green card.
